Terms, billing and privacy

In short: we use your email to send you your site and your alerts, a generated site is a proposal until you activate it, we charge €24.90/month or €179.88/year (or $26.90 / $191.88 outside the euro area) including taxes with no commission per booking, and you can leave whenever you like.

What this service is

BistroHive generates a restaurant website from its public Google Maps listing, with a dashboard for bookings, pickup orders and deliveries carried out by the restaurant itself. A generated site is a proposal: it is not official until the restaurant activates it. The service is a tool: we are not a party to the contract between a restaurant and its customer, we do not handle payment for the food, and we do not guarantee bookings, orders, revenue or search rankings.

Trial and activation

The generated site is free. If you never confirm your email it is removed after 48 hours; confirming keeps it up for 30 days. Activating it means choosing a plan and starting a 30-day trial at no charge.

Price, taxes and renewal

The plan is €24.90/month or €179.88/year including taxes when we bill in euros, and $26.90/month or $191.88/year including taxes when we bill in US dollars; the currency follows the restaurant's country and is fixed at the first purchase. When the 30-day trial ends the first period is charged automatically and renews on its own, monthly or yearly, on the saved card. We email you before the first charge. We never take a commission on a booking or an order. We may update prices with at least 30 days' notice; the change applies at the next renewal and you can cancel free of charge before it does.

Cancellation and withdrawal

You can cancel any time from the dashboard, with no lock-in and no penalty: the service stays up until the end of the period already paid and is not charged again. As a consumer you have 14 calendar days to withdraw; if you ask the service to start before they end, you pay the proportional part of what was already provided. During the 30-day trial there is nothing to refund because nothing was charged.

Refunds and failed payments

If a charge is wrong, write to us within 14 days and we will review and refund it where due. If a payment fails we retry for a few days and let you know; if it stays unpaid the site is suspended and then cancelled, with the same deletion timeline as a normal cancellation.

If we discontinue the service

We may discontinue the service, in whole or in part, with at least 30 days' notice by email. If we do, we refund the unused portion of anything prepaid, and during that period you can export your bookings, orders and menu from the dashboard before the data is deleted. No further compensation is due for the discontinuation.

Acceptable use and suspension

You may not use BistroHive for illegal or fraudulent activity, to impersonate a business that is not yours, to publish content that infringes third-party rights or is offensive, or to send unsolicited messages to your customers. Nor to resell the service, automate it at scale, or attempt to reach other restaurants' data. We may suspend or close an account immediately and without refund where this clause is breached, or in case of fraud, an improper chargeback, or a legal or security risk.

Restaurant obligations and indemnity

The restaurant is solely responsible for honouring the bookings and orders it accepts, for food safety, for the accuracy of prices, opening hours, allergens and ingredients, for its own legal notices, and for holding the permits it needs to trade. You will hold us harmless against third-party claims, penalties, damages and reasonable defence costs arising from your restaurant's operation, from the content you publish, or from a breach of these terms.

Your email and your account

We ask for your email to send you the link to your site, your booking and order alerts and your billing. We never sell it or share it for marketing. You can change it or ask for its deletion from Settings or by writing to us. You are responsible for keeping your credentials secret and for activity carried out from your account.

Your customers' data: you decide, we execute

For your diners' data (name, phone, email, booking or order notes) you, the restaurant, are the controller; we act as processor and use it only to run the service, following your instructions. We never use it for our own purposes and never sell it. You can export or delete it from the dashboard at any time. Using BistroHive means accepting these terms as the data-processing agreement too.

Restaurant statistics

The bookings and orders you handle with BistroHive are recorded to deliver the service: confirming them, alerting you, resolving problems and showing you your business statistics in the dashboard (most-ordered dishes, occupancy by time slot, cancellations, no-shows and uncollected orders). This processing is necessary to perform the service you asked for and does not depend on the cookie notice. We also use aggregated, non-identifying data to measure product usage and improve it.

Who we work with

To run the service we rely on suppliers that may process data on our behalf: hosting and content delivery (Cloudflare), database and storage (Supabase), email delivery (Zoho), payments and invoicing (Stripe), usage analytics (PostHog) and advertising and campaign measurement (Meta), both hosted in the United States, and AI generation of text and images from public data. All are bound by confidentiality and security obligations equivalent to ours. An outage, an error or a change of terms at any of them is outside our control and creates no liability for us beyond what these terms provide.

Cookies and usage analytics

We use strictly necessary cookies for language, session and security. With your consent, we also use PostHog to understand in aggregate how the site is used and what converts, including session recordings and click maps in which all text and form fields are masked, plus where the visit came from (campaign parameters and referring site). Regardless of that choice, our server records service milestones (a site generated, a payment started, an activation or a cancellation) without cookies and without sending your contact details. If you arrive from a Meta ad, our server tells Meta that the visit happened and whether a site was generated, using the ad click identifier and technical data such as the IP. We never send your email or phone. If you accept, we also load the Meta pixel to measure how well our ads work; without your consent it is not loaded at all. If you do not decide or you decline, PostHog measurement runs without storing anything on your device (no cookies, no recordings, no profile) — just a session count. Analytics and advertising data are stored in the United States, under the international transfer safeguards required by law. We do not sell data. You can accept or decline browsing analytics from the cookie notice and change your mind at any time.

How long we keep data

While the service is active, bookings and orders are kept so you can consult and report on them. On cancellation the site goes offline, we delete its images after 30 days and the rest of its data after 90. Invoices are kept for as long as tax law requires.

Your rights and your customers' rights

Anyone can ask to access their data, correct it, delete it, restrict or object to its processing, and take it elsewhere. A diner should contact the restaurant first; if they write to hola@bistrohive.com we pass the request on and help resolve it. You can also complain to the Spanish Data Protection Agency.

AI-generated content

The menu, descriptions, translations and initial photos are written and generated by an AI model from public data and may contain mistakes. They are provided “as is”: the restaurant is responsible for reviewing them before publishing — prices, opening hours, ingredients and allergens above all — and can edit or replace them at any time in Settings. By publishing the site, the restaurant adopts that content as its own.

Ownership and licence

The BistroHive software, brand and design are ours. You keep ownership of your content (name, menu, photos, copy) and grant us a non-exclusive licence to host, display and technically adapt it for the sole purpose of running the service. That licence ends when the content is deleted.

Availability, warranties and liability

The service is provided “as is” and “as available”. We work to keep it online, but we do not warrant uninterrupted or error-free operation, nor any particular commercial outcome. We are not responsible for the bookings or orders a restaurant chooses to accept or refuse, nor for indirect damages, lost profits, lost custom, lost data or reputational harm. As far as the law allows, our total aggregate liability is limited to the amount actually paid for the service in the twelve months before the event giving rise to it. None of this excludes liability that cannot lawfully be excluded, nor any rights you have as a consumer.

Force majeure

We are not liable for failures caused by events beyond our reasonable control: internet or cloud provider outages, cyberattacks, disasters, strikes or decisions of an authority.

Changes to these terms

We may update them to reflect legal or service changes. If a change is material we notify you by email at least 30 days in advance; continuing to use the service after that counts as acceptance, and if you do not accept it you can cancel free of charge before it takes effect.

Governing law

These terms are governed by Spanish law. If you are a consumer, you may bring a claim before the courts of your place of residence; otherwise, before the courts of Madrid.
